Terms of Service

1. Overview

These Terms of Service ("Terms") govern your use of the D-Roc Gaming store and website (the "Service"). The Service is operated by D-Roc Gaming ("we," "us," or "our"). By accessing or purchasing from the Service, you agree to these Terms.

2. Accounts

You may create an account to track orders and manage preferences. You are responsible for safeguarding your account credentials and for all activity under your account. You must be at least 13 years old (or the minimum age in your jurisdiction) to create an account.

3. Products & Fulfillment

Our store offers three categories of products, each fulfilled and paid for differently:

• Physical merchandise is designed and fulfilled through our partner Fourthwall. Purchases for physical items redirect you to Fourthwall's secure checkout. Because the sale is completed on Fourthwall, physical merchandise is subject to Fourthwall's terms of service and Fourthwall's shipping and refund policies, which govern delivery timelines, returns, and chargebacks for those items. Our Shipping Policy and Refund & Returns Policy apply only to products sold directly by us.
• Songs and audio are listed through our partner SongFluxx. Purchasing an audio track redirects you to SongFluxx, where the sale and payment are completed on SongFluxx's platform. Those transactions are subject to SongFluxx's terms of service, payment processing, and refund policies. We do not collect payment for, process, or fulfill SongFluxx purchases — SongFluxx is solely responsible for the audio purchase, delivery of the file, and any refunds or disputes for those transactions.
• Digital products (such as custom overlays, emotes, and downloadable content) are sold directly by us and delivered electronically. Digital purchases are governed by our Digital Content License Agreement and our Shipping Policy and Refund & Returns Policy, and are non-refundable except where required by law.

4. Custom Requests

Custom product and custom song requests are quoted individually. Submitting a request does not guarantee acceptance or a quote. Pricing, scope, and delivery timelines are confirmed before any work begins; no custom work starts until payment terms are agreed.

5. Payments

Payments for digital and custom products are processed securely by us via Stripe. Physical merchandise is paid for through Fourthwall's checkout and processed by Fourthwall. Songs and audio are paid for through SongFluxx and processed by SongFluxx. We do not store your full card details. Each processor's terms and your cardholder agreement with that processor apply to the relevant transaction.

6. Intellectual Property

All content on the Service — including branding, product designs, music, artwork, and digital goods — is owned by or licensed to D-Roc Gaming and protected by applicable intellectual-property laws. Digital content is licensed, not sold; see the Digital Content License Agreement.

7. Acceptable Use

You agree not to misuse the Service, including attempting to disrupt it, circumvent payment, scrape or copy protected content, infringe others' rights, or use the Service for unlawful purposes.

8. Limitation of Liability

To the maximum extent permitted by law, the Service and products are provided "as is," and D-Roc Gaming is not liable for indirect, incidental, or consequential damages. For products sold through our partners (Fourthwall, SongFluxx), our liability is limited to our role in referring you to those platforms; the partner's terms govern the sale itself. Our total liability for any claim is limited to the amount you paid us directly for the relevant product.

9. Changes to Terms

We may update these Terms from time to time. The "Last updated" date reflects the most recent revision. Continued use of the Service after changes constitutes acceptance of the updated Terms.
